Terms of Service

1. What Mentioned is

Mentioned is a personal reference tool. You forward it posts and links you've seen on Instagram and other social channels; it identifies the places, titles and names inside them — using our AI provider to read the content and Google's Places and Maps to locate the places — and files them so you can find them again, including on a map.

It is a tool for organising material you already have access to. It is not a search engine, a social network, or a way of obtaining content you could not otherwise see.

2. Who can use it

You must be at least 13 years old. If you are using Mentioned on behalf of an organisation, you confirm you are authorised to bind that organisation to these terms, and "you" means both you and the organisation.

3. Your account

You sign in through Facebook, Apple or Google. Keep access to that account secure — you are responsible for what happens under your Mentioned account until you tell us it has been compromised, so tell us promptly at [email protected] if it is. One person, one account.

4. Your content

The list Mentioned builds you is yours. We don't claim ownership of it, and we don't transfer it to anyone else.

The posts and links themselves are usually made by other people on the platforms you saw them on. You're responsible for what you forward to us, and you confirm you have the right to share it and that doing so doesn't break the rules of the platform it came from or anyone else's rights.

To run the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, process and display what you share — but only to provide Mentioned to you, including sending the text to our AI provider to extract entities. That licence ends when you delete the item or close your account, subject to the short backup window described in our Privacy Policy.

We do not use what you share to train AI models, we do not publish it, and we do not show it to other users.

5. Acceptable use

• Don't save content you have no lawful access to, or that you obtained by circumventing a paywall, access control or platform restriction.
• Don't use Mentioned to scrape, bulk-collect or redistribute another platform's data.
• Don't upload material that is unlawful, that infringes someone's rights, or that contains malware.
• Don't use the service to harass, stalk or build a dossier on anyone.
• Don't reverse-engineer the app, or attack, probe or overload our infrastructure, or access it by automated means outside any API we publish.
• Don't resell or white-label the service without our written agreement.

We may suspend or terminate an account that breaches this section, and we will tell you why unless the law prevents us.

6. Third-party platforms

Mentioned connects to accounts you hold with other services. Your use of those services stays governed by their own terms. If a platform changes its rules or withdraws its interface, features that depend on it may stop working, and that is outside our control.

Mentioned is independent. It is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc., Apple Inc., Google LLC, or any other platform whose content you may save.

7. Accuracy of automated extraction

Map data, place names and coordinates come from Google and carry their own errors. We do not verify them.

8. Price

Mentioned is free to use right now. If we introduce paid features, we will update these terms and tell you before you're charged anything.

9. Availability and changes

We aim to keep Mentioned running, but we don't promise uninterrupted service. We may take it down for maintenance and may change, add or remove features. If we discontinue Mentioned altogether, we will give you at least 30 days' notice and a way to export your data first.

10. Our intellectual property

The Mentioned name, logo, interface, design and software belong to us and are protected by copyright and trademark law. These terms give you a personal, revocable, non-transferable licence to use the app as intended, and nothing more. Feedback you send us is welcome and unrestricted — if you suggest an improvement, we may use it without owing you anything.

11. Ending the agreement

You may close your account at any time by emailing [email protected]. Closing it deletes your content as described in our Privacy Policy.

We may suspend or terminate your account if you breach these terms, if the law requires it, or if continuing to serve you would expose us to legal risk. Except where a breach is serious, we will give you notice and a chance to put things right. The clauses on your content licence, our intellectual property, the disclaimer, liability and governing law survive termination.

12. Disclaimer

Mentioned is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Nothing here takes away rights you have under applicable law that cannot be waived.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, lost profits, or loss of data beyond what our backup practices would have recovered. Our total liability for all claims relating to Mentioned is capped at the greater of what you paid us in the 12 months before the claim (currently nothing, since the app is free) or US$100.

Nothing in these terms limits liability that cannot lawfully be limited, including for our own fraud, gross negligence, or wilful misconduct.

14. Governing law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, and the state and federal courts located in Delaware have jurisdiction over any dispute. Before going to court, please write to [email protected] — most things are faster to fix than to litigate.

15. General

These terms and the Privacy Policy are the whole agreement between us about Mentioned. If a court finds any clause unenforceable, the rest stays in force. Our not enforcing a clause on one occasion does not waive it. You may not transfer your rights under these terms; we may transfer ours to a successor in a merger or acquisition, on notice to you. We may update these terms, and where a change materially affects your rights we will notify you before it applies.
